TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of Attunly, a language-learning application ("App") operated by Mikesverse LLC ("we", "us", "our"). By creating an account or using the App, you agree to these Terms.

1. ACCEPTANCE OF TERMS

By accessing or using Attunly, you confirm that you are at least 13 years of age and agree to be bound by these Terms. If you do not agree, do not use the App.

2. ACCOUNT REGISTRATION

You must create an account to use Attunly. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to update it as necessary.

3. SUBSCRIPTION AND BILLING

Attunly offers both free and paid subscription tiers. Paid subscriptions ("Attunly Plus") are billed on a recurring basis (monthly or annually) through the platform where you made your purchase (Apple App Store, Google Play Store, or web). Prices are displayed before purchase. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period. Refunds are handled according to the policies of the respective app store or payment processor.

4. CONTENT AND INTELLECTUAL PROPERTY

All stories, audio recordings, translations, illustrations, and other content provided through Attunly are owned by or licensed to Mikesverse LLC. You may not reproduce, distribute, modify, or create derivative works from any App content without our prior written consent. Words and phrases you save to your personal dictionary remain associated with your account for your personal learning use.

5. USER CONDUCT

You agree not to: (a) use the App for any unlawful purpose; (b) attempt to reverse-engineer, decompile, or disassemble the App; (c) interfere with or disrupt the App's infrastructure; (d) share your account credentials with others; (e) scrape, crawl, or automatically extract content from the App.

6. PRIVACY

Your use of the App is also governed by our Privacy Policy. By using Attunly, you consent to the collection and use of information as described therein.

7. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIKESVERSE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. ACCOUNT TERMINATION

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through the App's Profile settings.

10. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use of the App after changes constitutes acceptance of the revised Terms.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
